NCLT Bangalore Bench Dismisses Insolvency Plea Against Flipkart
The National Company Law Tribunal (NCLT) Bangalore Bench has dismissed an insolvency petition filed against e-commerce giant Flipkart. The plea was filed by a creditor claiming unpaid dues of approximately Rs 1 crore. The NCLT observed that the creditor had not provided sufficient evidence to prove the default. The bench, comprising of Judicial Member Bhaskara Pantula Moses and Technical Member S. Rajesh, noted that the creditor had failed to demonstrate that Flipkart had committed any default in payment. The NCLT also observed that the creditor had not exhausted all other available remedies before approaching the tribunal. The dismissal of the plea is significant as it highlights the importance of creditors providing robust evidence to support their claims. The NCLT's decision is also expected to have implications for the e-commerce industry, where disputes over unpaid dues are common. The tribunal's ruling is likely to be seen as a positive development for Flipkart, which has been facing several legal challenges in recent times. The company has maintained that it has always honored its payment obligations and has a robust system in place to manage its finances. The NCLT's decision is subject to appeal before the National Company Law Appellate Tribunal (NCLAT).
